Terms of Service of Milano Mongolfiere
Definitions Used in the Terms of Service
Gift Voucher: A non-nominative voucher with a value in euros, redeemable for any activity on the website www.milanomongolfiere.com.
Ticket: A nominative travel document with a pre-established date.
You: The person who purchases the gift voucher/ticket and agrees to these “Terms of Service.”
We: Milano Mongolfiere.
1. By purchasing a gift voucher or ticket, you agree to be bound by these “Terms of Service.”
2. The purchase of the gift voucher/ticket can be made online via the milanomongolfiere.com website or by email at info@milanomongolfiere.com.
3. Flights can be booked online, by phone or by e-mail.
4. You have the right to withdraw within 14 days of purchasing the gift voucher, provided that you have not already set the flight date.
5. The ticket is nominative, and in the case of a name change, please notify us by email. Before the flight, the new beneficiary must sign these “Terms of Service” to confirm acceptance. The gift voucher is non-nominative.
6. The gift voucher entitles you to participate in a hot air balloon flight experience on a date to be agreed upon within 2 years of purchase. Unless otherwise specified, it includes the balloon flight, a toast after landing, transportation by one of our off-road vehicles from the meeting point to the take-off location, and from the landing site back to the meeting point, as well as the aviation insurance required by current legislation.
6.1 For tickets purchased on partner sites other than www.milanomongolfiere.com, please refer to the validity details provided on the partner site.
7. A hot air balloon flight is entirely dependent on weather conditions. Your flight may be canceled at any time if the weather is not favorable, even shortly before take-off.
For group flights, the flight may be rescheduled if the minimum number of participants is not reached. If a flight is canceled due to weather or any other reason, we will propose a new date for the flight. However, we will not refund the ticket or any costs related to transportation, food, or accommodation.
8. If flights are suspended due to force majeure, the validity of the ticket will be extended for a period equal to the suspension duration. However, we are not responsible for any financial losses or damages resulting from such a suspension.
9.The gift certificate is non-refundable, except in the following cases:
• Cancellation within 14 days from the date of purchase, provided no flight date has been booked (see point 4).
• Refunds are issued exclusively to the person who purchased the gift certificate.
9.1 For gift vouchers purchased through partner sites other than www.milanomongolfiere.com, please refer to the cancellation and refund policies of the respective partner site.
10.The ticket is non-refundable, except in the following cases:
• If you provide a medical certificate at least one month before the ticket expires, stating that you are unable to fly and will remain unable to do so for the entire remaining validity period of the gift certificate.
• If you are not a resident of Italy
10.1 For tickets purchased through partner sites other than www.milanomongolfiere.com, please refer to the cancellation and refund policies of the respective partner site.
11. A deduction equal to 20% of the cost of the gift voucher or ticket will be applied to all refunds to cover general expenses incurred by us, except in the case of withdrawal as outlined in point 4.
12. If you are unable to fly within the validity period of the gift voucher/ticket due to pregnancy, we will extend the validity for 12 months, provided that we receive written notification within the first 4 months of pregnancy.
13. The gift voucher is valid for 2 years from the date of purchase. If you do not activate the gift voucher by booking a date within this time frame, the voucher will expire, and you will forfeit any right to use it.
Extension
Vouchers issued by Milano Mongolfiere Srl can only be extended upon explicit request from the customer, provided that a written request is sent via email to info@milanomongolfiere.com within the expiration date, or no later than 7 days after the expiration.
After these terms, no voucher can be extended and it will expire permanently.
Extension costs:
• 3 months: €50 per person
• 6 months: €90 per person
14 .You can change or cancel your booking by calling us and sending an email up to 5 days before your flight. Cancellation requests sent via WhatsApp or SMS are not valid.
15. If you fail to meet the deadline for changing your booking as outlined in point 18, or if you do not show up on time at the meeting point for the flight, you forfeit any right to use the gift voucher/ticket and will not receive a refund. However, it is possible to pay a penalty of €150.00 per person to reactivate the gift voucher/ticket, which will then be valid for an additional six months from the date of the last booking made.
General rules
16. Our flights are scheduled to last between 45 and 60 minutes, but the pilot, for safety reasons, has the sole responsibility of determining the duration, conduct of the flight, and the time and location of landing. Therefore, we cannot guarantee the exact duration or direction of the flight, as these cannot be predetermined.
17. We reserve the right to assign the execution of our flights to other operators who hold valid ENAC licenses and have a collaboration agreement with us. In such cases, these “Terms of Service” will always apply.
18. Milano Mongolfiere has insurance coverage for air carriers pursuant to Regulation (EC) No. 785/2004 and Regulation (EU) No. 285/2010 for each passenger, in the event of death and / or personal injury. In all cases, compensation is not due or is due to a lesser extent if it is proved that the damaged passenger is responsible for the damage or has contributed to it through negligence, wrongful act or omission. The right to compensation for damages expires within two years from the day of the flight.
19. We accept no responsibility for any damage to cameras, video cameras, mobile phones, or other personal items you bring on the flight. We also disclaim any responsibility for damage to your car or its contents while it is parked at the meeting point during the flight.
20. Ballooning can be as risky as any other sport, hobby, or activity. By purchasing a gift voucher or participating in a flight, you acknowledge and accept these risks. The flight will always be under the control and supervision of a pilot certified by the National Aviation Authority (ENAC), who is committed to ensuring that the flight is as safe and enjoyable as possible.
21. We are not qualified to assess your health or determine whether you are fit to fly. However, for your safety and that of other passengers, you must ensure that you are in good physical condition to participate in the flight.
You cannot fly if:
a. You are pregnant.
b. You have suffered injuries or undergone surgeries that limit your ability to walk, or if you have osteoporosis.
c. You are unable to maintain the correct position for landing (bending your knees while holding onto the handles).
d. You are under the influence of drugs or alcohol.
e. You are a child under 8 years old or shorter than 130 cm.
If you have any doubts, consult your doctor and provide us with a medical certificate confirming your eligibility to fly. It is important to address any concerns regarding your health, as they could affect your safety and that of other passengers.
22. The pilot is obligated, as required by the Navigation Code, to exclude you from the flight if, in their opinion, you pose a risk to the safety of the flight or to the safety of other passengers and yourself. In this case, you will not be entitled to any refund.
23. Only children over 8 years old and at least 130 cm tall can participate in our flights. Teenagers under 16 must always be accompanied by an adult, while those aged 16-18 must have written authorization signed by a parent.
24. You must wear appropriate clothing and footwear as specified on our website.
25. Persons over 115 kg are required to pay a surcharge of 50% of the ticket price.
26. Smoking is prohibited within a 50-meter radius of the balloon during the inflation and deflation phases, as well as in the basket during the flight.
27. Dangerous goods, ammunition, and weapons of war are not permitted on board.
28. Milano Mongolfiere reserves the right to modify these “Terms of Service” at any time without prior notice to the public.
29. You consent to the processing of your personal data for internal administration and accounting purposes.
30. If the crew or passengers are subjected to verbal or physical violence, or if your behavior or that of your companions disrupts the smooth operation of the activity, we reserve the right to cancel any existing gift voucher, with or without a refund.
31. Special Conditions for “Last Minute” Tickets
All conditions applicable to gift vouchers/ordinary tickets apply to tickets purchased at the last-minute rate, except for paragraph 3 of point 8, which is replaced by the following:
“If the flight is not carried out due to adverse weather conditions, the holder of the last-minute ticket will be redirected to a “last-minute” flight on a date of their choice, subject to availability, with a three-day notice.”
32. The competent court for any disputes shall be in Milan.
PROHIBITED ITEMS ON BOARD THE HOT AIR BALLOON
Transport of items deemed dangerous to flight safety is not permitted on board the hot air balloon, such as: animals, firearms, scissors, pocket knives, knives, axes, Swiss army knives, or tools used for agricultural, scientific, sports, industrial purposes, and similar items, as well as realistic reproductions of firearms. The use of electronic cigarettes (E-Cigarettes), pipes, and electronic cigars is prohibited on board. Lighters may only be carried on board on the person.
ICAO classifies all substances and materials that, by their nature, may pose a risk to air transport and prohibits their introduction into carry-on luggage.
These products include:
• Document holders with alarm devices
• Compressed gases (refrigerants, flammable, non-flammable, and toxic), such as butane, oxygen, liquid nitrogen, camping gas, and self-rescue breathing apparatus cylinders
• Corrosive agents, including acids, alkalis, mercury, and liquid cell batteries
• Explosives, weapons, and ammunition (excluding hunting or sporting items), strip capsules, fireworks, and rockets
• Flammable liquids and solids, such as lighters, fuels, matches, paints, and solvents
• Liquids exceeding the quantities set by Regulation EC 185/2010 (e.g., oil, vinegar, wine, etc.), even if perfectly packaged
• Liquids that are not perfectly packaged (the packaging must prevent leakage that could damage other luggage)
• Other dangerous items, such as magnetic materials, harmful, toxic, foul-smelling, or irritating substances, and oxidizers (e.g., bleaching powder and peroxides)
• Poisons, infectious substances, insecticides, herbicides, and materials containing pathogens
• Radioactive substances
• Alarm devices and any lithium batteries installed to power them
• Underwater torches with inserted batteries
